By accessing or using our sites and services, you, the Service Recipient ("Service Recipient"), hereby agree to be bound by these terms and all terms incorporated herein by reference. If you do not accept these terms and conditions, please do not use this website or any of the services provided by Kapital Analytics LTD.

Acceptance of terms

The following Terms of Service Agreement ("TOS") is a legally binding agreement that shall govern the relationship with our Service Recipients, users, and others who may interact or interface with Kapital Analytics LTD., located at Winslow House, Church Lane, Sunningdale, Ascot, Berkshire, SL5 7DD, United Kingdom, in association with the use of the DataMarx.ai website ("Site"), its Services, and Content which shall be defined below.
These Terms and Conditions are governed and interpreted pursuant to the laws of the United Kingdom, without reference to its conflicts of law principles, to the extent such principles would apply to the law of any other jurisdiction.
These Terms and Conditions are the entire agreement between the parties relating to the subject matter herein and supersede all previous communications, understandings, and agreements.

Copyright and Trademark Information

This Site and the information that it contains, such as text, graphics, images, data, reports, links, information obtained from licensors, services, and other material contained on this Site or provided through the Services, including all data and information obtained and received from the Site and Kapital Analytics LTD. (the "Content"), are the property of Kapital Analytics LTD., are protected from unauthorized copying and dissemination under both United Kingdom and foreign copyright, trademark, patents, and other intellectual property laws.

The data included in and produced by the Services provided by the Site and Kapital Analytics LTD. will not be re-circulated, redistributed, or published by the Service Recipient except for internal purposes without the prior written consent of Kapital Analytics LTD.

Warranties and limitations of liability

KAPITAL ANALYTICS LTD. CAN NOT GUARANTEE THE AVAILABILITY, PROVISION, QUALITY, ACCURACY, INTEGRITY, OR RELIABILITY OF THE SERVICES AND CONTENT, AND SUCH SERVICES AND CONTENT ARE PROVIDED "AS IS".
Kapital Analytics LTD. and the Content it provides do not provide Commercial Advice and are for informational purposes only.
Kapital Analytics LTD. makes no warranty as to results attained by the Service Recipient or others from the Services, and there are no express or implied warranties of merchantability or fitness for a particular purpose or use.
Kapital Analytics LTD. will have no responsibility or liability, contingent or otherwise, for any injury or damages, whether caused by the negligence of Kapital Analytics LTD. or any of its employees, arising in connection with the Services rendered under the TOS and will not be liable for any lost profits, losses, punitive, incidental or consequential damages or any claim against the Service Recipient by any other party.

Scope of services

You, the Service Recipient, will receive specifically ordered Content or other deliverables ("Deliverable"), or a certain number of access licenses. The Service Recipient acknowledges and agrees that only a maximum of 1 (one) Service Recipient is authorized to access the Deliverable provided by the Service unless explicitly authorized otherwise in writing by Kapital Analytics LTD.
If the Service Recipient subscribes to access the Deliverables on an ongoing basis, they shall be granted access rights to the Deliverables and any additional features generally made available on the Site while the Service Recipient is in good standing. If the Service Recipient purchases a one-time Deliverable available from the Site or Kapital Analytics LTD., such as a report or analysis, these terms apply only to that purchase and do not provide any ongoing right to access or use the Services.
The identity of the authorized Service Recipient is the signatory of this Agreement and may not be changed without prior written consent from Kapital Analytics LTD.
Content and features are subject to change or termination without notice at the sole discretion of Kapital Analytics LTD.

Use of Content

The Service Recipients’ right to use the Site and Services is limited in scope, revocable, personal, non-transferable, and non-exclusive. Provided that you abide by all times with these terms and conditions and any separate agreement between you and Kapital Analytics LTD., and subject to the limitations set forth herein, Kapital Analytics LTD. will provide you with access to the Site and to the extent you subscribe or purchase Content or Deliverables. The Service Recipients’ are responsible for obtaining any equipment and Internet service necessary to access the Site and any Content or Deliverables provided by Kapital Analytics LTD.
The Service Recipients’ may view, copy, download, and print Content, subject to the following conditions:
(1) the Content may be used solely for the Service Recipient’s internal informational purposes;
(2) the Content shall not be accessed or used in any manner restricted by electronic prevention measures on this Site and any Deliverable provided by Kapital Analytics LTD; and
(3) copyright, trademark, and other proprietary notices may not be removed from any Content or other materials obtained from the Services;
(4) The Service Recipient shall not: (a) modify, adapt or create derivative works based on the Site, the Services available from Kapital Analytics LTD., or any Content and Deliverables obtained from them; (b) "frame" or "mirror" any Content or create Internet "links" to or from the Website; or (c) disassemble, reverse engineer, or decompile the Services provided via this Website or Content, or access the Website or Content in order to build a competitive product or service, build a product or service using similar ideas, features, functions or graphics, or copy any ideas, features, functions or graphics.
If You violate any of these Terms and Conditions, The Service Recipients’ permission to use the Content automatically terminates and the Service Recipient must immediately destroy any copies of any portion of the Content.
